By accessing or using the LuxeTravel platform, website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2 Definitions

• "Platform" refers to the LuxeTravel website, mobile application, and all related services.
• "User" refers to any individual or entity using the Platform.
• "Booking" refers to any reservation, purchase, or transaction made through the Platform.
• "Provider" refers to airlines, hotels, bus operators, tour operators, and other travel service providers.
• "Content" refers to all information, data, text, images, and materials available on the Platform.
• "Agent" refers to a registered travel agent using the Platform to make bookings on behalf of customers.

3 User Accounts

3.1 Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update it promptly.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3.3 Account Types

• Customer: Standard user account for booking travel services.
• Agent: Professional travel agent account with commission and markup capabilities.
• Admin: Platform administrator account with full management access.

4 Bookings & Payments

4.1 Booking Process

When you make a booking through our Platform, you are entering into a direct contractual relationship with the Provider (airline, hotel, etc.). LuxeTravel acts as an intermediary facilitating the booking process.

4.2 Pricing & Fees

Prices displayed on the Platform are subject to change without prior notice. The final price will be confirmed at the time of booking and may include taxes, fees, and service charges.

4.3 Payment

All payments are processed through our secure payment gateway. You authorize us to charge the payment method provided for all bookings made through your account. We accept major credit/debit cards, UPI, and net banking.

4.4 Cancellation & Refunds

Cancellation and refund policies vary by Provider. Please review the specific terms before booking. LuxeTravel will process refunds in accordance with the Provider's policies and applicable laws.

5 User Obligations

By using our Platform, you agree to:

• Provide accurate and truthful information.
• Comply with all applicable laws and regulations.
• Use the Platform only for legitimate travel booking purposes.
• Not engage in fraudulent or deceptive activities.
• Not disrupt or interfere with the Platform's functionality.
• Respect the intellectual property rights of LuxeTravel and third parties.

6 Agent Terms

If you register as an agent, the following additional terms apply:

• Commission: You will earn commissions on bookings made through your account as per the agreed rate.
• Markup: You may apply markup to bookings in accordance with your configured settings.
• Wallet: Commissions will be credited to your wallet and can be withdrawn as per the withdrawal policy.
• Compliance: You must comply with all applicable regulations for travel agents.
• Customer Information: You are responsible for the accuracy of customer information provided.

7 Prohibited Activities

You are expressly prohibited from:

• Using the Platform for any unlawful purpose.
• Impersonating any person or entity.
• Transmitting viruses or malicious code.
• Attempting to gain unauthorized access to Platform systems.
• Scraping or copying content without permission.
• Interfering with other users' enjoyment of the Platform.
• Engaging in any activity that could harm LuxeTravel's reputation.

8 Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, and software, is the property of LuxeTravel or its licensors and is protected by copyright, trademark, and other intellectual property laws.

• LuxeTravel and the LuxeTravel logo are registered trademarks.
• You may not reproduce, distribute, or create derivative works from Platform content without prior written consent.
• You retain ownership of any content you submit, but grant us a license to use it for Platform operations.

9 Disclaimers

The Platform and all content are provided "as is" and "as available" without warranties of any kind, express or implied.

• We do not guarantee the accuracy of Provider information.
• We are not liable for any losses or damages arising from bookings.
• We are not responsible for the conduct of Providers or other users.
• We do not guarantee uninterrupted or error-free Platform access.

10 Limitation of Liability

To the maximum extent permitted by law, LuxeTravel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the booking that gave rise to the claim.

11 Indemnification

You agree to indemnify and hold LuxeTravel, its affiliates, officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of third parties.

12 Termination

LuxeTravel reserves the right to suspend or terminate your account and access to the Platform at any time, without notice, for any reason, including violation of these Terms.

Upon termination, all rights granted to you under these Terms will cease, and you must immediately stop using the Platform.

13 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

We will notify you of material changes via email or through the Platform. It is your responsibility to review these Terms periodically.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
